California Loan Modification Firm Banned In Wisconsin

According to its website, the Federal Loan Modification Law Center, LLP existed “to utilize [its] intimate knowledge of Federal and Consumer Homeowner Laws to help [its] clients in this housing crisis that is threatening the American Dream.”  This company would contact borrowers across the country, including in Wisconsin, and offer them assistance with foreclosure alternatives like loan modifications and short sales.

 

It turns out that after collecting an up-front fee ranging from $1,500 to $2,500, the Federal Loan Modification Law Center would fail to provide borrowers any assistance.

 

In April, a federal district court in California enjoined the company from representing to people that it could offer foreclosure avoidance assistance.  Now, the Wisconsin Department of Financial Institutions has prohibited the Federal Loan Modification Law Center from doing business in Wisconsin.  Additionally, the company has been directed to refund all of the money it received from Wisconsin residents in exchange for its services.

 

Another California company known as 21st Century Legal Services failed to provide the modification help it promised to a Milwaukee couple – after collecting $3,500 from them.  While no action has been taken by Wisconsin authorities, 21st Century Legal Services has been sued by attorneys general in at least three other states.

 

These episodes highlight a threat for which to remain on the lookout.  As more people run into trouble paying their mortgages and face foreclosure, more companies are springing up to prey on those looking for help.  The Federal Trade Commission has compiled a list of red flags that can help you avoid being victimized by a scam.  You should avoid any business that:

 

  • guarantees to stop the foreclosure process – no matter what your circumstances
  • instructs you not to contact your lender, lawyer, or credit or housing counselor
  • collects a fee before providing you with any services
  • accepts payment only by cashier’s check or wire transfer
  • encourages you to lease your home so you can buy it back over time
  • tells you to make your mortgage payments directly to it, rather than your lender
  • tells you to transfer your property deed or title to it
  • offers to buy your house for cash at a fixed price that is not set by the housing market at the time of sale
  • offers to fill out paperwork for you
  • pressures you to sign paperwork you haven’t had a chance to read thoroughly or that you don’t understand.

    Watch Live - Speaker's Task Force on Preventing Foreclosure
    Assembly Speaker Mike Sheridan has appointed a Special Task Force to study Wisconsin's foreclosure problem, and the panel will convene for its third and final public meeting today in Baraboo.

    The Wisconsin Foreclosure Assistance Resource Center
    The Wisconsin Realtors Association has set up a foreclosure information website called the Wisconsin Foreclosure Assistance Resource Center.  The site includes helpful information on the foreclosure process, options available to borrowers seeking to avoid or delay foreclosure, and links to local resources and statistics.

    Wisconsin Bankruptcy Filings Up 30% in the First Half of 2009
    According to the American Chronicle, Wisconsin bankruptcy filings were up 30% in the first half of 2009.  Many of those filing were by people who lost their jobs, and needed relief from credit card balances, utility bills, medical expenses and home equity loans.

    June 2009 Madison Area Foreclosures Up 91% Over June 2008
    According to the Capital Times, Madison area home foreclosures in June 2009 were up 52% from May 2009, and up 91% from June 2008.  The Associated Press reported that the foreclosure crisis has now moved out of the sub-prime market, and is affecting the fixed-rate prime market due to rising unemployment.
     
    Unfortunately, many people facing foreclosure will wait too long to consult with an attorney.  Many times foreclosure proceedings can be stopped, but this gets more difficult as time goes on.
